Terms of Service

These Terms of Service govern your use of the Idle Hour Studios website, games, and related services, including Descent Defender and future titles, features, live-service systems, and support channels. By accessing or using the services, you agree to these terms.

Scope and Acceptance

These terms apply to our website, game applications, accounts, virtual items, support interactions, purchases, subscriptions, live operations, and other related services that link to or reference these terms. If you do not agree to these terms, do not use the services.

Eligibility and Authority

You may use the services only if you are legally able to enter into this agreement. If you are under the age of legal majority where you live, you may use the services only with permission from a parent or legal guardian where required by applicable law. If you use the services on behalf of another person or entity, you represent that you have authority to bind them to these terms.

Limited License to Use the Services

Subject to your compliance with these terms, Idle Hour Studios grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the services for your personal, non-commercial entertainment use. This license does not give you any ownership rights in the services or any content, software, virtual items, or intellectual property made available through them.

Accounts

Some features may require an account, guest session, linked account, or platform authentication. You are responsible for maintaining the security of your account credentials, device access, and linked login methods, and for activity that occurs through your account or device to the extent caused by your failure to safeguard them. Information you provide to us or through platform services must be accurate and kept reasonably current where relevant.

We may suspend, restrict, or require verification of accounts if we reasonably believe there is abuse, unauthorized access, fraud, security risk, policy violation, or another legitimate operational or legal reason to do so.

Updates, Online Services, and Availability

The services may evolve over time. We may add, remove, rebalance, patch, discontinue, or limit features, content, events, systems, online functionality, compatibility, or service access. Online features may be unavailable temporarily or permanently, and availability may vary by product, device, platform, account status, region, age gate, or local law.

Virtual Items, Currencies, Progression, and Entitlements

The services may include virtual currencies, consumables, non-consumables, unlocks, passes, rewards, progression systems, cloud saves, leaderboards, tournament entries, subscriptions, or other digital features and entitlements. These are licensed, not sold, and are provided solely as part of the services. Except where required by applicable law, they have no real-world cash value, are not redeemable for money, and do not create any personal property, ownership, or vested rights.

We may manage, modify, rebalance, replace, revoke, retire, reset, or remove virtual items, progression, rewards, or entitlements as part of operating the services, addressing errors, responding to fraud or abuse, complying with legal obligations, or improving the game experience. We may also refuse, cancel, or adjust grants or restores that we reasonably believe were obtained through abuse, error, or unauthorized transactions.

Purchases, Billing, Subscriptions, and Refunds

Purchases and subscriptions offered through the services may be processed by platform operators, app stores, storefronts, or third-party billing providers. Your purchase may also be subject to the terms, billing policies, and usage rules of the relevant platform or provider.

Refund eligibility, cancellation rights, and billing disputes are generally handled by the storefront or billing provider that processed the transaction, except where applicable law requires otherwise. If a transaction is reversed, refunded, revoked, charged back, or found invalid, we may remove or adjust the related entitlements, restores, promotional grants, progression benefits, or access where appropriate.

If subscriptions are offered, they may renew automatically unless canceled in accordance with the rules of the relevant platform or billing provider. Subscription management is typically handled through the applicable platform account unless the product states otherwise.

Prohibited Conduct

You agree not to, and not to assist or encourage others to:

Cheat, bot, exploit bugs, manipulate matchmaking or progression, or use unauthorized software, scripts, mods, tools, or automation.
Reverse engineer, decompile, disassemble, or attempt to extract source code, underlying ideas, or non-public systems except where non-waivable law expressly permits it.
Interfere with, disrupt, overload, probe, or circumvent the security, integrity, or operation of the services or related infrastructure.
Use the services for unlawful, fraudulent, harmful, abusive, defamatory, harassing, or infringing conduct.
Abuse customer support, refund systems, promotional systems, trial systems, account recovery tools, or compensation processes.
Sell, rent, transfer, share, or commercially exploit accounts, virtual items, or access to the services except where we expressly allow it.
Upload, submit, or distribute content that infringes intellectual property or other rights, or that contains malware or harmful code.

User Content and Feedback

If you send us feedback, suggestions, ideas, bug reports, or similar submissions, you agree that we may use them without restriction or obligation to you, unless applicable law requires otherwise. If you submit content through the services or support channels, you represent that you have the rights needed to do so and that your submission does not violate the law or the rights of others.

Intellectual Property

The services, including the website, games, software, code, systems, text, artwork, music, audiovisual content, design, trademarks, logos, and other materials, are owned by Idle Hour Studios and its licensors and are protected by intellectual property and other applicable laws. Except for the limited license granted above, all rights are reserved.

Suspension and Termination

We may suspend, limit, remove content from, revoke entitlements within, or terminate access to any part of the services if we reasonably determine that doing so is necessary for security, fraud prevention, operational integrity, legal compliance, platform compliance, protection of other users, investigation of misconduct, or enforcement of these terms. We may also discontinue the services or any part of them at any time.

Disclaimers

To the fullest extent permitted by applicable law, the services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We do not guarantee uninterrupted availability, error-free operation, continued support, compatibility with all devices or regions, or that progression, cloud-save data, purchases, or other records will never be lost, delayed, or corrupted.

Limitation of Liability

To the fullest extent permitted by applicable law, Idle Hour Studios and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, account access, virtual items, or other intangible losses arising out of or relating to the services or these terms.

To the fullest extent permitted by applicable law, our total liability for claims arising out of or relating to the services or these terms will not exceed the greater of the amount you paid us directly for the specific service giving rise to the claim during the twelve months before the event giving rise to the claim or twenty U.S. dollars (US$20.00). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless Idle Hour Studios and its affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, and costs, including reasonable legal fees, arising out of or related to your misuse of the services, your violation of these terms, or your violation of any law or third-party rights.

Governing Law and Disputes

These terms are governed by the applicable law of the jurisdiction most closely connected to Idle Hour Studios and the operation of the services, unless another law is required to apply by your local consumer protection rules or other non-waivable legal requirements. Before filing a formal claim, you agree to contact us first at dante.carbone@idlehourstudios.com and try in good faith to resolve the dispute informally.

Changes to These Terms

We may update these Terms of Service from time to time as our services, business operations, platform requirements, and legal obligations evolve. When we do, we will update the Effective Date on this page, and material changes may also be communicated through the services or other reasonable notice methods. Your continued use of the services after the updated terms take effect means the revised terms apply to your use, to the extent permitted by law.
